Byrd & Gonzales Blog Obama's Immigration Executive Order (How To Apply)

Obama's Immigration Executive OrderLast night our president, Barrack Obama, announced that he will be signing and implementing an Executive Order that will grant Temporary Protection Status (TPS) to parents of children who are U.S. citizens or have current permanent legal resident status. There are many confusions as to the requirements to apply for this TPS and its benefits. I will start by discussing the benefits. The most evident benefits is that these individuals will be able to apply for work permits. This is beneficial to both the alien and our economy. How does it benefits the alien (immigrant)? For starters many of these individuals are victims of fraud. "An employer" will hire them and then never pay them for their services. So basically they work for free. Alternatively they have very poor working conditions and the compensation often times will be lower than the minimum wage. Once they obtain a work permit, they will be able to obtain regular employment without the threat of being deported or that the fruits of their labor is not compensated. How does it benefit us? More tax income for the government. Once they are lawfully employed they will be subject to the same tax requirements we are subject to. This means that they will contribute to reduce our deficit. So who qualifies and how can they apply?Anyone who has resided in the U.S. for at least 5 years and who is a parent to a child who is a permanent resident or U.S. citizen qualifies to apply for TPS under Obama's Executive Order. In order to apply, they must be willing to:submit themselves to a background checkpay taxesgo to the back of the line when applying for residency. In addition to the above, the Executive Order will expand the age restrictions for those who may qualify for DACA (Dream Act), increase border security, increase foreign investment by allowing entrepreneurs to open business in the U.S., it will permit for individuals waiting for visas, to travel and much more. Overall, the benefits outweigh the risks.Every great President, has taken a stand and acted based on his ideals regardless of what their political oppositions say; i.e. Thomas Jefferson, Abraham Lincoln and Zachary Taylor. All of these presidents opposed slavery, the equivalent of immigration issue of their time. They all took a stand and thanks to them we have a free U.S. for all. Obama took a stand, he is outspokenly fighting for what he believe is right, and that in itself is admirable. For additional information on immigration services, please contact me at 813-281-8801 or via email at oxalis@bgpalaw.com
